Terms and Conditions for SUSQUAL Management
Welcome to SUSQUAL Property Management. These Terms and Conditions (the “Agreement”) govern your use of our services and outline the responsibilities of both SUSQUAL Property Management (“Company”) and you, the Client (“Client”). By entering into an agreement with SUSQUAL, you acknowledge your acceptance of these Terms and Conditions and agree to comply with all stipulations herein.
1. Introduction
At SUSQUAL, we pride ourselves on delivering tailored property management services that ensure seamless operations, optimal tenant relationships, and regulatory compliance. These Terms and Conditions form a binding contract and are essential for clarifying the rights, responsibilities, and obligations of both parties.
2. Definitions
For the purpose of this Agreement:
- Company: Refers to SUSQUAL Property Management.
- Client: Any individual, group, organization, or entity entering into an agreement with the Company to utilize property management services.
- Property/Properties: The residential, commercial, or mixed-use real estate assets managed by SUSQUAL under this Agreement.
- Services: All property management services provided by SUSQUAL, as detailed in the specific service agreement with the Client.
- Agreement: The contractual arrangement between SUSQUAL and the Client, inclusive of these Terms and Conditions.
3. Scope of Services
SUSQUAL provides comprehensive property management services, including but not limited to:
3.1 Operational Management
- Routine maintenance and repair coordination.
- Vendor management and procurement of third-party services.
- Ensuring cleanliness, safety, and functional operations of all properties under management.
3.2 Tenant Relations
- Tenant screening, lease negotiation, and administration.
- Resolving tenant disputes and managing tenant communications.
- Enforcing lease agreements, including collection of rents, fees, and deposits.
3.3 Financial Management
- Rent collection and disbursement of funds.
- Preparation of financial reports, including profit and loss statements, cash flow analysis, and budgets.
- Managing utility payments, insurance premiums, and property taxes on behalf of the Client.
3.4 Regulatory Compliance
- Ensuring properties meet all local, regional, and national property laws.
- Coordinating with relevant authorities for inspections, certifications, and permits.
3.5 Sustainability Initiatives
- Implementing energy-efficient practices and recommending sustainable upgrades.
- Promoting eco-friendly solutions to enhance property value and reduce environmental impact.
4. Client Obligations
The Client agrees to:
- Provide Accurate Information
- Supply accurate, current, and comprehensive property details necessary for the provision of services.
- Maintain Communication
- Respond promptly to inquiries or requests from SUSQUAL related to property management.
- Financial Responsibilities
- Ensure timely payment of all fees, expenses, and reimbursements as per the Agreement.
- Compliance with Laws
- Abide by all applicable property and tenancy laws relevant to the managed properties.
- Support Sustainability Goals
- Support and approve environmentally sustainable practices proposed by SUSQUAL where feasible.
5. Company Responsibilities
SUSQUAL is committed to:

- Ensuring that all managed properties adhere to legal and regulatory requirements.

6. Fees and Payments
- Service Fees
- Fees for property management services will be detailed in the specific contract and depend on the property type, size, and scope of services.
- Payment Terms
- Payments are due as outlined in the Agreement. Late payments may incur penalties or interest as specified in the Agreement.
- Additional Costs
- Any services beyond the agreed-upon scope (e.g., major renovations, emergency repairs) will be billed separately, with prior approval from the Client.
7. Confidentiality
SUSQUAL and the Client agree to keep all sensitive information shared during the course of this Agreement confidential, including but not limited to:
- Tenant details.
- Financial data.
- Strategic or operational plans.
SUSQUAL will not disclose any such information without the Client’s consent, except as required by law.
8. Limitations of Liability
- Force Majeure
- SUSQUAL is not liable for damages or service disruptions caused by unforeseen circumstances, including natural disasters, pandemics, or acts of government.
- Indirect Damages
- The Company is not responsible for indirect, incidental, or consequential damages arising from its services.
- Maximum Liability
- The Company’s liability is limited to the total amount of service fees paid by the Client within the 12 months preceding any claim.
9. Termination of Agreement
- Termination by the Client
- The Client may terminate this Agreement with prior written notice as specified in the contract. Early termination may result in additional fees, as outlined in the Agreement.
- Termination by SUSQUAL
- SUSQUAL reserves the right to terminate the Agreement for non-payment, breach of terms, or illegal activities associated with the managed properties.
- Post-Termination Obligations
- Both parties must settle any outstanding financial or operational matters within 30 days of termination.
10. Dispute Resolution
In the event of a dispute, both parties agree to:
- Engage in mediation to resolve the issue amicably.
- If mediation fails, submit the dispute to binding arbitration under the laws of [insert jurisdiction].

11. Sustainability Commitment
